These Terms and Conditions govern your access to and use of the website www.sweetretreatcakes.com and our custom cake, baked goods, and related services provided by Sweet Retreat Cakes. By accessing the Site, placing an order, contacting us, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Site or Services.

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.

1. Use of the Site and Services

  • You must be at least 18 years old or the age of majority in your jurisdiction to use our Services or place orders.

  • You agree to provide accurate, current, and complete information when ordering or contacting us.

  • We reserve the right to refuse service, cancel orders, or terminate access for any reason, including violations of these Terms.

2. Orders and Custom Cakes

  • All orders are custom-made and made-to-order. Cakes and perishable items cannot be resold or returned once produced.

  • Designs, colors, flavors, and decorations are our artistic interpretation based on your requests, photos, or descriptions. We do not guarantee exact replicas of inspiration images due to handmade artistry, ingredient availability, and structural needs.

  • We may make minor adjustments for stability, safety, or feasibility (e.g., structural supports, size variations).

  • You are responsible for providing accurate details (e.g., event date/time, address, allergies, guest count). We rely on this information to fulfill orders.

3. Pricing, Payments, and Deposits

  • Prices are quoted in USD and subject to change. Quotes are valid for 7 days from issuance as availability and accessibility may change.

  • On orders over $75 - a 50% non-refundable deposit is required to secure your booking date, ingredients, and design work.

  • Full payment is due 72 hours prior to pickup/delivery or by the specified deadline. We accept all major Debit and Credit Cards, Venmo, and Cash.

  • Unpaid balances may result in order cancellation and forfeiture of deposit.

  • Taxes, delivery fees, or additional charges are not included in initial quote unless specifically requested.

4. Cancellations, Changes, and Refunds

5. Pickup, Delivery, and Liability

  • Once the cake leaves our possession (pickup or delivery), it becomes your responsibility. We are not liable for damage, spoilage, accidents, or issues after handover (e.g., transport mishaps, improper storage, heat exposure).

  • For delivery: You must provide accurate address and access instructions. Additional fees apply for changes or delays.

  • Cakes are perishable and best consumed soon after event (ideally same day). We recommend refrigeration/storage instructions provided at handover.

  • You assume all risk for allergies or dietary needs — notify us in advance. We make efforts to accommodate but cannot guarantee allergen-free production.

 

6. Intellectual Property

  • Photos of our cakes may be used for portfolio, marketing, or social media without compensation (unless you request otherwise in writing).

  • You grant us a non-exclusive license to use any photos or designs you provide for fulfilling your order.

  • All content on our Site (designs, text, images) is our property or licensed to us; do not copy or use without permission.

7. Limitation of Liability

  • To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages (e.g., lost profits, emotional distress).

  • Our total liability for any claim is limited to the amount you paid for the specific order.

  • We provide Services "as is" without warranties of any kind, express or implied (including merchantability or fitness for a particular purpose).

8. Indemnification

You agree to indemnify and hold us harmless from claims arising from your misuse of the Site/Services, inaccurate information provided, or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of laws principles. Any disputes will be resolved in courts located in Summit County, Utah.

10. Severability

If any provision is invalid, the remainder remains in effect.

11. Entire Agreement

These Terms (plus our Privacy Policy, No Return Policy, and any signed order contract) constitute the full agreement.
